Download our agreement and we will visit the Clerk of Superior Court in the county where the foreclosure happened. We will verify the sale produced surplus funds and the exact amount the sheriff is holding.
File your petition in the same county where the sale occurred (under N.C. Gen. Stat. § 45-21.36). This includes: Foreclosure judgment or order confirming sale, Sheriff’s deed, Letters testamentary/administration Property description, Affidavit of heirship (if multiple heirs), & Any required filing fee
You must give notice to, the lender, any lienholders, & the foreclosure sale purchaser. The court will schedule a hearing. Bring your documents and explain why the estate is entitled to the funds.
If approved, the court will issue an order releasing the surplus. Take the order to the sheriff, show ID, and receive the funds.
